5 NHS Compensation Claims

Medical Negligence. In order for negligence to be regarded as a potential claim, there needs to be validation of certain facts. There needs to be actual proof that a doctor is guilty and that a negative result was found to exist in the patient whether that be mental, internal or physical. There have been cases filed against doctors where they were aware of the risks but did not make the patient or his family aware.

Medical Malpractice. As opposed to pure negligence, this is a more overall lack of responsibility being taken. Again, there needs to be proof any wrong-doing by the doctor i.e. a failure to act in accordance with the medical body’s opinion. If patients feel that malpractice has taken place or have been given misinformation about an illness, they could make a claim.

MRSA. There are an increasing number of people receiving hospital treatment for minor injuries or ailments who end up catching MRSA and becoming far worse. There is much justification in making a claim in this case as this simply shouldn’t have happened. Clinical negligence is not necessarily easy to prove, however. Compensation claims can be made with a ‘no win, no fee’ situation which makes making a claim easier.

Work Accidents. The NHS are not only obliged to ensure that hospitals are safe for patients but for its employees also. There is undoubtedly potential for life-threatening working situations to occur as expert and common sense advice from contractors often goes ignored. The courts impose huge fines in such cases which can be avoided by the hospital through ensuring that its staff are not exposed to health and safety hazards and at risk of catching diseases that kill.

Infected Blood. In the 70s and 80s in the UK, blood transfusions from Skid Row was not uncommon. This has resulted in diseases in much of that blood being passed on; diseases as HIV and Hepatitis C. Family members of some of those who were unlucky enough to have had those diseases transmitted are considering filing claims against the NHS. Blood was being imported form the US at the time who were compensating their donors.
